Both Abortion Issues & Private School Scholarship Repeal Will Be on the Nebraska November Ballot

LINCOLN — The Nebraska Supreme Court  has ruled that both abortion related measures can remain on the November ballot. 

The court weighed constitutional questions this week raised by three lawsuits. Justices, in a unanimous 7-0 ruling, decided both initiatives met the Nebraska Constitutional requirement that ballot measures cover no more than a single connected legal subject.

"We determine that the Initiative does not include multiple subjects, and instead we determine that the provisions of the proposed constitutional amendment are naturally and necessarily related to the general subject. We therefore conclude that the Initiative does not violate the single subject rule."

And continue: "Within the context of the proposed Initiative, the use of additional words upon which Brooks and LaGreca rely are not separate subjects but facets of the singular subject to create a constitutional right to abortion. We therefore conclude that the relators are not entitled to the writs of mandamus requested in their respective original actions.

In addition, the court ruled that the private school scholarship referendum will also appear on the ballot. All three cases are detailed below.
